Canadian citizens and permanent residents living in Canada, 18 years of age or older, may sponsor close relatives or family members who want to become permanent residents of Canada. Sponsors must promise to support the relative or family member and their accompanying family members for a period of three to 10 years to help them settle in Canada

You can sponsor relatives or family members from abroad if they are:

  • spouses, common-law or conjugal partners 16 years of age or older;
  • parents and grandparents;
  • dependent children, including adopted children;
  • children under 18 years of age whom you intend to adopt;
  • brothers, sisters, nephews, nieces or grandchildren who are orphans; under the age of 18 and not married or in a common-law relationship; or
  • you may also sponsor one relative of any age if you do not have an aunt, uncle or family member from the list above who you could sponsor or who is already a Canadian citizen, Indian or permanent resident.

The Immigration and Refugee Protection Act also allows for sponsorship of foreign nationals who are in a same-sex relationship with a permanent resident or citizen of Canada.

Spouses of permanent residents and Canadian citizens who have temporary legal status in Canada may be sponsored from within Canada under the Spouse in Canada Class. However, in certain circumstances, spouses of permanent residents and Canadian citizens who do not have temporary legal status in Canada may also be sponsored under Humanitarian and Compassionate Grounds.

LICO (Low Income Cut Off)

If landed immigrants want to sponsor members of the Family Class, they are required to demonstrate that they are able to support all of the people that they wish to sponsor as well as all of their dependants already in Canada (except in spousal sponsorship cases where no income verification is necessary). This is accomplished using a formula designed by the government.

Under special circumstances however you may be able to sponsor your family to Canada where you cannot meet the LICO amount. Please contact ImmiGlobe for a consultation and further information on this issue.
