Many people apply to immigrate, and get
refused. If that is has been the case for you, perhaps your case
was:
- Not well prepared; you were
missing documents; the evidence you had didn't prove your
credentials; the visa officer caught you saying things
inconsistent with your application, or documents, or both.
- You may have applied under the
old regulations, and didn't qualify; however, you might qualify
under the new regulations. Or there may have been a court case
which interpreted the regulations differently than your visa
officer did.
In any case, it's not the end
- You will usually have the right
to appeal the decision, and have the decision reviewed by a judge.
These procedures can be quite costly, however, and if you have
passed the specified time limits, you may not have those options.
Please note, the time to file an appeal is limited (usually 15
days)
- You can also submit a new
application for a visa even after you have been refused; any new
application must be considered on its own merits. However, with a
prior refusal, you need to be prepared to document your case
thoroughly. We usually recommend doing a search of your
immigration file prior to submitting a new application. A search
of the refused file will give you the opportunity to address any
concerns that were raised before.

refusal. The search usually takes 30 to 60 days, and can include
all applications that you have ever made at any Canada Immigration
office in the world
to visit, work, study, or immigrate. we'll order a search to find
out what the real problems were with your previous applications;
often, the rejection letters do not tell the whole story so we
must ensure that you explain any difficulties that there were
before proceeding.
- Detailed Case Preparation:
Only when we have all the facts will we prepare your case. We'll
deal with the problems or inconsistencies in your previous files,
and anticipate questions or issues that the new Immigration
officer will likely have.
